Section 01 — Who We Are

This Privacy Policy applies to Kikaboni ("Kikaboni," "we," "us," or "our"), the operator of kikaboni.com (the "Site"). We sell dietary supplements and wellness products directly to consumers through our online store.

Section 02 — Information We Collect

We collect information in the following ways:

Information you provide directly: Name, email address, phone number, billing and shipping address, and payment information when you place an order, create an account, or contact us.

Information collected automatically: IP address, browser type, device identifiers, pages visited, time spent on the Site, referring URLs, and cookie data collected through standard web technologies.

Information from third parties: Data from payment processors (e.g., Shopify Payments, PayPal), marketing platforms (e.g., GoHighLevel, Klaviyo), and analytics tools (e.g., Google Analytics) that we use to operate and improve our services.

Communications data: Messages, inquiries, and responses exchanged between you and Kikaboni via email, SMS, chat, or our contact form.

We do not collect sensitive personal information such as Social Security numbers, government-issued IDs, or financial account numbers beyond what is required to process your payment (handled securely by our payment processor).

Section 03 — How We Use Your Information

We use the information we collect to process and fulfill your orders and communicate order status and shipping updates; provide customer support and respond to your inquiries; send transactional communications including order confirmations, receipts, and return updates; send marketing communications via email and SMS where you have given consent (see Sections 05 and 06); personalize your experience and recommend products relevant to your purchase history; analyze Site performance and improve our products, services, and user experience; detect, investigate, and prevent fraudulent transactions and other illegal activity; and comply with applicable legal obligations.

Section 04 — Legal Basis for Processing

Where applicable law requires a legal basis for processing your personal data (such as under GDPR or applicable U.S. state privacy laws), we rely on the following:

Contract performance: To process and fulfill your orders.

Legitimate interests: To improve our products and Site, prevent fraud, and manage our business relationships.

Consent: For email and SMS marketing communications, where you have explicitly opted in.

Legal obligation: To comply with applicable laws, regulations, and lawful government requests.

Section 05 — Email Communications

We send two types of email communications:

Transactional Emails are sent in connection with your orders and account activity and are not marketing in nature. These include order confirmations and receipts, shipping notifications and tracking updates, return and refund status updates, and password reset and account security alerts. You cannot opt out of transactional emails while you have an active account or open order, as they are necessary to fulfill our obligations to you.

Marketing & Promotional Emails: With your consent, we send promotional emails about new products, special offers, wellness content, and brand updates. By providing your email address at checkout or subscribing via our website, you consent to receive marketing emails from Kikaboni. You may opt out at any time by clicking the "Unsubscribe" link in any marketing email or by contacting us at support@kikaboni.com. Opt-out requests are processed within 10 business days. Unsubscribing from marketing emails does not affect delivery of transactional emails.

We do not sell your email address to third parties. We do not send emails on behalf of other brands without your separate consent.

Section 06 — SMS & Text Message Communications

Kikaboni operates an SMS messaging program to deliver timely, relevant communications to customers who have opted in. Our SMS program complies with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and applicable carrier requirements.

Consent & Opt-In: By providing your mobile phone number and checking the SMS consent box at checkout, on a sign-up form, or by texting a designated keyword to our number, you expressly consent to receive automated text messages from Kikaboni at the number provided. Consent is not a condition of purchase. Message types may include order confirmations, shipping alerts, abandoned cart reminders, promotional offers, product launches, and re-engagement messages. You may receive up to 4–6 messages per month. Message and data rates may apply based on your mobile carrier plan.

How to Opt Out: Reply STOP to any Kikaboni text message to unsubscribe — you will receive one final confirmation and no further texts will be sent. Reply HELP at any time for support information. You may also contact us directly at support@kikaboni.com. After opting out, you may re-subscribe at any time by texting START to our number or by re-entering your phone number on our website.

Carrier Disclosure: Kikaboni is not responsible for any charges incurred through your mobile carrier. Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost, U.S. Cellular, and Metro PCS. For help, text HELP or email support@kikaboni.com.

Your Phone Number & Data: Your mobile phone number is used solely to deliver Kikaboni SMS communications and is stored securely within our marketing platform. We do not sell, rent, or share your phone number with unaffiliated third parties for their own marketing purposes. Your number may be shared with our SMS service provider solely for the purpose of sending messages on our behalf.

Section 07 — Cookies & Tracking Technologies

We use cookies, pixel tags, and similar tracking technologies to operate the Site and improve your experience. Essential cookies are required for the Site to function (e.g., shopping cart, session management). Analytics cookies help us understand Site usage patterns (e.g., Google Analytics). Marketing cookies are used to deliver targeted advertising and track campaign performance (e.g., Meta Pixel, Google Ads).

You can control cookie preferences through your browser settings or our cookie consent banner. Disabling certain cookies may affect Site functionality.

Section 08 — Sharing of Information

We do not sell your personal information. We may share your information with trusted third parties in the following circumstances:

Service providers: Vendors who assist us in operating the Site and delivering our services, including payment processors, shipping carriers, email and SMS platforms, analytics providers, and customer support tools. These parties are contractually prohibited from using your data for their own marketing purposes.

Legal compliance: When required by law, court order, or lawful government request, or to protect the rights, property, or safety of Kikaboni, our customers, or others.

Business transfers: In connection with a merger, acquisition, or sale of all or a portion of our business assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

Section 09 — Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this policy. Order and transaction records are retained for a minimum of 7 years for tax and accounting compliance. Email marketing consent records are retained for the duration of your subscription plus 3 years. SMS consent and opt-out records are retained for a minimum of 4 years in accordance with TCPA record-keeping best practices. When data is no longer needed, we delete or anonymize it in accordance with our internal data management procedures.

Section 10 — Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information, including SSL/TLS encryption for data transmitted to and from our Site, secure access-controlled systems for storing customer data, and payment processing handled entirely by PCI-DSS compliant third-party processors — Kikaboni does not store full payment card numbers.

No method of transmission over the internet is completely secure. In the event of a data breach that affects your rights, we will notify you as required by applicable law.

Section 11 — Your Privacy Rights

Depending on your location, you may have the following rights with respect to your personal information:

Access: Request a copy of the personal data we hold about you. Correction: Request that we correct inaccurate or incomplete data. Deletion: Request that we delete your personal data, subject to legal retention requirements. Portability: Request your data in a structured, machine-readable format. Opt-out of marketing: Unsubscribe from email or SMS marketing at any time (see Sections 05 and 06). Non-discrimination: We will not deny you products, charge different prices, or provide a different level of service because you exercised a privacy right.

Section 12 — California Residents — CCPA / CPRA

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA): the right to know what personal information we have collected, used, disclosed, or sold about you; the right to delete your personal information (subject to certain exceptions); the right to correct inaccurate personal information; the right to opt out of the sale or sharing of your personal information (Kikaboni does not sell personal information); and the right to limit the use of sensitive personal information.

Section 13 — Children's Privacy

Our Site and products are not directed to individuals under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us immediately at support@kikaboni.com.

Section 14 — International Visitors

Our Site is operated in the United States. If you are visiting from outside the U.S., your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using our Site, you consent to this transfer. If you are located in the European Economic Area (EEA) or United Kingdom, you may have rights under the GDPR or UK GDPR — please contact us to exercise those rights.
